These General Conditions are intended to purchase products and services made remotely via the Internet from the website managed by the company.

These General Conditions of Sale shall apply to all deliveries made by ONE TOUCH Merchandising & Events, S.L. (hereinafter ONE TOUCH) or on behalf of its website www.onetouchstyle.com, unless the Specific Offers establish conditions other than these.

 

ACCEPTATION OF GENERAL SUCH CONDITIONS

The Customer, via e-mail gives confirmation of your purchase order, accepts unconditionally and undertakes to fulfil your relationships with the virtual store. The general and payment conditions are those indicated in this contract, stating that the Customer has read and accepted all the indications given to him in the terms of the said regulation, and also to bear in mind that the virtual store itself is only linked to the conditions previously established in writing.

The sale and supply of products by ONE TOUCH Merchandising & Events, S.L. (hereinafter ONE TOUCH) are subject to the present general conditions of procurement (the "Conditions," and the contract between the Customer and ONE TOUCH governed by these Conditions will be jointly designated as the "Contract"), without any other different or additional conditions which may be contained in any order, document or other communication (the "Order") and which modify, alter or contradict the terms of this Agreement. No term or condition which is pre-printed in any other Customer document, such as Orders or Confirmation, shall alter or supplement the terms of this Agreement, even if ONE TOUCH has not objected to such additional or conflicting terms.

 

CLIENT OBLIGATIONS

The General Terms of Sale should be read in line by the customers visiting the page and the virtual store before confirming their purchases. Therefore, the sending of the order confirmation implies the absolute knowledge of these General Conditions of Sale and their full acceptance. The Customer undertakes, after the completion of the online purchase process, to print and preserve the present general conditions of sale, already read and accepted during the purchase process, in order to comply fully with the Spanish Law.

The Customer shall be solely responsible for the damage caused by the inadequate use, storage, storage or handling of the Products, where he has not observed any indications, warnings or instructions that ONE TOUCH has been able to provide.

TO MAKE A CALL IN VIRTUAL LAND

The Customer makes the purchase of the products, available as described in LINEA in the descriptive and technical data sheets, at the price with VAT included. Before confirming the purchase to the Customer, the unit cost of each pre-selected product or the total cost in case of purchase of more than one product will be recapitulated. When confirming the purchase, and at the end of the transaction, the Customer will receive the information of the Number, the Date, the total amount of your Order and its number or shipping key by which you will be able to track and know the status of the Order at all times.

 

PAGOS

Payment of the goods purchased and the costs related to their issue will have to be made by the Customer when sending the order confirmation by credit or debit card.

If the income credited by the financial institutions is not made, the order shall not be taken into account.

In the event of a total or partial non-payment of the price of a product order, at the expiry date, and pursuant to Law 3 / 2004 of 29 December, establishing measures to combat late payment in commercial transactions, Article 5, the amount paid and not paid shall bear the corresponding late interest without the need for notice of maturity or any intimation by ONE TOUCH, in addition to the customer's account for the refund costs incurred by ONE TOUCH. In addition, ONE TOUCH will be entitled to suspend or cancel outstanding deliveries of Products to the Customer until the order for which payment is due is paid and payable, or to require the payment of any new order in advance.

 

DISPLACEMENT AND ENVIRONMENT OF THE

Our warehouse will be considered the place of delivery of all transactions. The date of delivery shall be when the payment has been made or when the goods are ready for delivery / delivery.

ONE TOUCH reserves the right to sell in the regions or countries it considers, which may, without notice, limit or, where appropriate, exclude the sale of its products in any of them.

Depending on the country of destination the shipping costs will vary.

Depending on the country, different customs / tax charges will be applied. These costs shall be borne by the customer receiving the order.

GENERAL

The realization of an order in the online store involves the acceptance by the Customer of these legal conditions. No stipulation made by the Customer may differ from those of The Online Store if it has not been expressly accepted in advance and in writing by The Online Store.

Any liability of ONE TOUCH for damage caused by defects in the Products is excluded, except where it is expressly bound to do so under applicable mandatory law, such as in cases of death or bodily injury. Thus, ONE TOUCH will not be liable for indirect damage, loss of profits, loss of production or profit.

In any event, if ONE TOUCH is required to assume its liability for damages suffered by the Customer, it shall be limited to a amount equivalent to the amount corresponding to the order of the Product causing the damage, unless a mandatory law imposes a higher quantitative limit on ONE TOUCH.

 

PRICES

The published prices are valid except in case of typographic error or lack of stock. The prices shown for products INCLUDING VAT for the European Union and are exempt from VAT for the United States. Shipping costs are NOT included.

The prices are understood with the material placed in our ONE TOUCH warehouse, and in no case include taxes or transport costs. The packaging is included in the price unless expressly indicated.

ONE TOUCH may change the sales prices of the Products at any time. The increase in the sales price shall not affect those orders for ongoing products which have previously been accepted by ONE TOUCH. In the event that the Customer made an order for products with a wrong price, ONE TOUCH will inform you of the right price and, where appropriate, your acceptance to issue the order, provided that the Customer expressly confirms it (with the right price) in the next two (2) days.

Prices are subject to change at any time. The prices only express the value of the Products and do not include taxes, shipping, carrying or customs duties, as well as any other charges or costs, such as those relating to the special packaging and labelling of the Products, permits, certificates, declarations and customs records (together, "Additional Costs"). The additional costs will be borne by the Customer.

The prices published on this website correspond to the Community currency "euro."

Customers whose countries of residence operate in a currency other than the euro must take into account that the financial institutions in charge of the means of payment enabled by the online store always take the equivalence for their payment. CONDITIONS OF PAYMENT

BACKGROUND

ONE TOUCH reserves the right to interrupt the delivery of goods requested, without incurring any liability, in the event of non-payment by the Customer on its maturity of any outstanding amount or in the event of the client's economic insolvency.

The delivery of the products will always be in total form of the purchase, no fractionations due to the character of the products, except expressly requested from the Customer and prior acceptance by ONE TOUCH.

ONE TOUCH will deliver the Products according to the terms INCOTERM and agreed with the Customer.

Except in cases where ONE TOUCH indicates other written terms. All product deliveries will be CPT - INCOTERMS 2010 (Carriage Paid To - Transport paid to agreed port or destination). The title and risk of loss shall be transferred to the Customer at the time of delivery of the Products to the carrier. Any delivery date provided by ONE TOUCH should be understood only as an estimate, which depends on the timely receipt of supplies. ONE TOUCH will not be held responsible for any delay in delivery. ONE TOUCH reserves the right to make partial deliveries, in which case the Customer must accept such delivery and pay for the delivered products. The delay in the delivery of any part of an Order shall not give the Customer the right to cancel the other deliveries.

 

CLAIMS AND DEVOLUTIONS

Any claim for damage to the goods will have to be brought to our attention within forty-eight (48) working hours in Spain following the receipt of the shipment, in order to be able to make the corresponding claim to the carrier.

In the event of a return by error in the shipment or for reasons attributable to ONE TOUCH, no consignments shall be accepted at appropriate ports. Our firm will take care of the appropriate efforts, both to remove the wrong goods and to replace the correct one.

Any claim for non-shipment or error in the same shall be notified within 48 working hours in Spain from the date of shipment of the material.

The Customer will not have the right to request return if you have not reported the error / defect by sending an e-mail to the Customer Service  hola@onetouchstyle.comwithin forty-eight (48) working hours in Spain following the receipt of the order to inform us of the problem.

The products supplied by ONE TOUCH shall be used only for the uses indicated by the respective manufacturer. The Customer shall be solely responsible for the consequences that may arise from the improper use of the products supplied.

Claims for damages made by the Customer for any cause are expressly excluded where there is no serious fault or no fault by ONE TOUCH.

The customer's conformity with the quantity delivered in respect of an order in question shall be made by signing the corresponding order at the same time as its delivery. If the Customer does not make a claim about a possible defect in quantity or quality in the time specified after receiving the Products, ONE TOUCH will not take any responsibility.

The Customer shall examine the Products as soon as possible after their receipt to verify their conformity with the type of Product to be ordered, and the absence of apparent or hidden defects on them. In any case, upon receipt of the Products, the Customer shall have a period of 15 (15) days to claim ONE TOUCH for any difference in type of products delivered with those requested or for the existence of an apparent defect in them. To detect a possible internal or non-apparent defect in the Products.

The products in the event of return must be in the same state in which they were originally delivered, new without use, with all the labelling intact and the respective accessories.

ONE TOUCH will not accept changes or returns for customer errors when selecting the size or color of the product.

In cases where it is appropriate to reimburse the Customer, ONE TOUCH will have the fertilizers within a peremptory period and in the same way as the purchase was made, using its own supplier (Visa, MasterCard, etc.), not taking responsibility for the management times of the above-mentioned suppliers.

For reimbursement of ONE TOUCH to customers whose currency is not the euro, MUTATIS MUTANDIS must be taken the point (Customers whose countries of residence operate with a currency other than the euro must take into account that financial institutions in charge of the means of payment enabled by the online store always take the equivalence for their payment. The costs of return shall be borne by the Customer and shall be deducted from the amount repaid upon acceptance of the return of the purchase.

 

GUARANTEES

ONE TOUCH guarantees the quality and reliability of the products, ending this at the time the goods have been modified, handled or dismantled, since any modification is understood to be made under the responsibility of the Customer.

To the extent permitted by applicable laws, neither ONE TOUCH nor its employees nor its agents shall be liable, and the Customer shall not be entitled to claim, for any indirect, special, occasional or consequential damage, or for any arising damage or loss of profits, which may be caused; for example, they shall not be liable for loss of profit or income, data losses, interruptions in use, reprocessing, additional manufacturing costs, damage to good reputation, or customer losses. To the extent permitted by applicable laws, and only in the case of direct damage, ONE TOUCH shall compensate the Customer with an amount that may never exceed the original price of the product in question. In so far as the applicable laws do not consider such liability limitations to be applicable, the total liability of ONE TOUCH in any incident shall in no case exceed CIEN (100) EUROS or its equivalent.
